Terms and Conditions

Welcome to PharmaDS. These Terms and Conditions ("Terms") govern your use of our mobile application, which provides online ordering of pharmacy products, prescription upload services, and home delivery of medications. The App is operated by Pharmacie de Niederkorn (Kirt, Camille Marcel Jean).

By downloading, registering, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to register and use the App. By using the App, you represent that you are legally capable of entering into binding contracts. If you are using the App on behalf of another person (e.g., a family member), you represent that you have the legal authority to act on their behalf and to provide their personal and health information.

2. Account Registration

To access the App’s features, you must register an account using accurate, current, and complete information, including your full name, email address, mobile phone number, and delivery address(es). You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is false or incomplete.

3. Pharmacy Services and Prescriptions

3.1. The App allows you to upload prescription images for fulfillment by licensed pharmacists. You warrant that any prescription you upload is valid, current, and issued by a legally authorized healthcare provider. We reserve the right to reject or refuse any prescription that appears fraudulent, expired, altered, or invalid.

3.2. All medications and pharmacy products are subject to availability. Certain medications may require additional verification or pharmacist consultation before dispensing. We do not guarantee that every product listed in the App will be in stock.

3.3. You acknowledge that the final decision to dispense any medication rests with the supervising pharmacist in compliance with applicable pharmacy laws. We reserve the right to cancel any order if the prescription is deemed inappropriate, unsafe, or non-compliant with regulations.

4. Ordering and Payments

4.1. By placing an order through the App, you make an offer to purchase the selected products. We may accept or reject your offer. Order confirmation is subject to prescription validation and stock availability.

4.2. Prices displayed are in local currency and include applicable taxes unless stated otherwise. We reserve the right to change prices at any time without prior notice, but such changes will not affect orders already accepted.

4.3. Payment must be made via the payment methods available in the App (credit/debit card, digital wallets, or other options). By providing payment information, you represent that you are authorized to use the selected payment method. All payment transactions are processed by third-party payment processors; we do not store full payment card details.

5. Home Delivery

5.1. We offer home delivery of pharmacy products to the address you provide during checkout. Delivery times are estimates and not guaranteed. We are not liable for delays caused by courier services, weather, or other events beyond our reasonable control.

5.2. Risk of loss or damage to products passes to you upon delivery. You must inspect the package upon receipt; if the package appears tampered with or damaged, you should refuse delivery and notify us immediately.

5.3. Certain products (e.g., temperature-sensitive medications) may have special delivery requirements. You agree to provide accurate delivery instructions and ensure that someone of legal age is present to receive the delivery when required by law.

6. Returns, Refunds, and Cancellations

6.1. Due to health and safety regulations, prescription medications and opened health products are generally non-returnable and non-refundable unless required by applicable law. Non-medication items (e.g., over-the-counter products in original sealed packaging) may be eligible for return within 7 days of delivery.

6.2. If we cancel your order due to prescription invalidity or stock unavailability, we will issue a full refund to the original payment method.

6.3. You may cancel an order before it has been processed by our pharmacy team. Once the order status changes to "preparing" or "dispensed", cancellation may no longer be possible. Please contact customer support for cancellation requests.

7. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable law or regulation.
• Upload fake, altered, or fraudulent prescriptions or attempt to obtain controlled substances unlawfully.
• Interfere with or disrupt the App’s functionality or security.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use any robot, spider, or automated device to access the App without our permission.
• Harass, abuse, or harm any person, including our pharmacists, delivery personnel, or support staff.

8. Intellectual Property

All content and materials available on the App, including but not limited to text, graphics, logos, icons, images, software, and trademarks, are the property of Pharmacie de Niederkorn (Kirt, Camille Marcel Jean) or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent. You retain ownership of any prescription images you upload, but you grant us a limited license to use, store, and share them solely for the purpose of fulfilling your orders and complying with legal requirements.

9. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal and health information. By using the App, you consent to the collection and processing of your data as described in the Privacy Policy.

10. Disclaimer of Warranties

11. Limitation of Liability

To the fullest extent permitted by applicable law, Pharmacie de Niederkorn (Kirt, Camille Marcel Jean), its affiliates, pharmacists, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the App or the services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid for the specific order giving rise to the claim, or 50 EUR if no payment was made.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pharmacie de Niederkorn (Kirt, Camille Marcel Jean), its pharmacists, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (i) your violation of these Terms, (ii) your use of the App, (iii) any prescription or information you provide, or (iv) your violation of any rights of another person or entity.

13. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases, but provisions that by their nature should survive (e.g., indemnification, limitation of liability, governing law) shall remain in effect.

14. Governing Law and Dispute Resolution

14.1. These Terms shall be governed by and construed in accordance with the laws of your country, without regard to conflict of law principles.

14.2. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in Luxembourg in accordance with the rules of the arbitration. Either party may seek injunctive relief in court to protect its intellectual property rights.

14.3. You agree that any claim against us must be filed within one year after the cause of action arises, or it will be permanently barred.

15. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated to you via in-app notice or email. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and delete your account.

16. Miscellaneous

16.1. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.2. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16.3. These Terms constitute the entire agreement between you and Pharmacie de Niederkorn (Kirt, Camille Marcel Jean) regarding the use of the App and supersede any prior agreements.
